            A neutral arbitrator ordered the Village of Stickney to reinstate a fired employee, with back pay.  The Village fired the employee, a long time telecommunicator with the Village, for wearing a dress uniform at the 2010 Police Officer’s Memorial in Springfield, failing to call in one day while on paid administrative leave, failing to complete a fitness for duty evaluation, and lying. 

            The Arbitrator concluded that the evidence supported the Employee’s contention that she had been given permission to wear the uniform. She also concluded that the Employee cooperated with the fitness for duty evaluation before it was suspended so she could obtain advice about her rights from her attorney.  Her failure to call in on the day she was at the fitness for duty evaluation was not cause for discharge; the Arbitrator did not find evidence to support the Employer’s dishonesty allegation.
